Step 1: Check the Alienation Restriction Period of Your Flat

As the owner of a Home Ownership Scheme or Tenants Purchase Scheme flat, you have the right to sell the flat. However, there are alienation restrictions imposed on flats sold under these schemes, and such restrictions vary according to the period of time of the flat counted from the date of first assignment.

Step 2: Know Your Options

If your flat is within the first 2 years from the date of first assignment If your flat is within the 3rd -5th year from the date of first assignment If your flat is over 5 years from the date of first assignment
You must first sell it back to the Housing Authority at the original purchase price (for HOS flats) / list price (for TPS flats). You can sell it back to the Housing Authority at an assessed buyback price, which is the assessed market value less the original purchase discount.

OR

If the HA declines to accept the buyback application, you can pay the premium and then either sell or let it in the open market.

OR

You can sell it in the HOS Secondary Market, in which case you do not need to pay any premium.

Step 3: Beware of the Consequences

Owners of HOS / TPS flats are not eligible for Public Rental Housing (PRH) flats no matter they have sold their HOS / TPS flats or not.  Consideration will be given, however, to individual cases under very special circumstances (for example, on compassionate grounds subject to recommendation by the Social Welfare Department and approval by the Director of Housing).
